Purpose and legal basis for the processing of personal data

According to the “Order on non-commercial sailing and other traffic on Gudenåen” all motorised vessels operating on the Gudenå River must be registered. Everyone can obtain a guest permit, but to obtain a permanent permit for your motorized vessel you must be a resident, own a summer cottage or rent a mooring place in one of the municipalities Hedensted, Horsens, Skanderborg. Silkeborg, Favrskov, Viborg or Randers.

To check whether you are eligible for a permanent permit the municipalities need information (= data) about you and your vessel.

Your application for a permanent permit for a motorized vessel will be processed by the municipality where you are resident, own a summer home or have a rented mooring place. Exempted are applicants from Horsens and Hedensted municipalities as applications from residents from these municipalities are processed by Skanderborg municipality.

Your personal data are processed in accordance with the REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regards to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

By submitting your application for registration of your vessel you consent for your data to be processed and stored in the Municipalities database of vessels (see Article 6 (1) (a) of the Data Protection Regulation. The data about you comes solely from your completion of the application form. You name, address, telephone number (if any) are collected as well as email and information about the vessel. These data are classified as non-sensitive. You may revoke your consent to process your personal data by contacting the Gudenå Committees office (makla@silkeborg.dk)


We keep your personal data for this period

Data is stored in a database during the time your registration is active. When your registration has not been active for 5 years, all information about you will be deleted. If you wish to be deleted before this time period, please contact the Gudenå Committees office (makla@silkeborg.dk)


The following will have access to your personal data

Motorized vessels:

Your personal data will be accessible to the Police, The Fire and Rescue service, Søhøjlandet Nature Agency, as well as the municipalities (Viborg, Favrskov, Silkeborg, Skanderborg, Horsens and Hedensted municipalities).

If your vessel has a non-private mooring place your name and data about the vessels will be forwarded to the site manager for verification.

Non-motorized vessels:

Your personal data is accessible to the municipalities (Randers, Viborg, Favrskov, Silkeborg, Skanderborg, Horsens and Hedensted).

Your rights

According to the Data Protection Regulation you have several rights in relation to the processing of your data. You can use your rights at any time. To do so contact the relevant municipality.

Your rights are:

  • Right to receive your data.
    You have the right to gain insight into the data that the municipality have about you as well as a right to receive other data.
  • Right to rectification.
    You have the right to obtain the rectification of inaccurate personal data concerning you.
  • Right to erasure.
    Authorities are subject to strict requirements for documentations so a request from you to delete your data can only be granted to a very limited extent.
  • Right to restriction of processing.
    You may, in certain cases, have the right to restrict the processing of your personal data. Where processing has been restricted, such personal data shall, with the exception of storage, only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest.
  • Right to object.
    In some cases, you may object to the municipalities otherwise legitimate processing of your personal data.

Complaints
